Use of Microsoft 365 potentially illegal in Germany – ICT news

Using Microsoft 365 would violate EU privacy law, GDPR. This is the opinion of a working group consisting of federal and state privacy supervisors in Germany.

In a statement, German regulators allege several objections to the use of Microsoft 365 by German organizations. These include the possibility for US authorities to request data from European users. Another reason given is Microsoft’s own data processing notice, which does not provide enough explanation about data processing for its own purposes. For example, the Microsoft 365 User Agreement states that Microsoft may use end user data for commercial purposes.

The statement currently only represents an assessment of the situation and therefore does not lead to a direct execution. It is unclear if and when the regulators’ judgment will be converted into a policy measure.
